On 19 March 2024, the European Commission sent a Statement of Objections to an insulation panels maker alleging that the company provided incorrect, incomplete and misleading information during #merger control proceedings for the company's planned #acquisition of a mineral fibre sandwich panel producer. These investigations of the European Commission demonstrate yet again that the Commission expects companies to provide accurate and complete information, and moreover to strictly comply with procedural rules during merger #proceedings. The CMS Funds Group Guides have been updated to reflect the implementation of the Cross-border Distribution of Funds Directive (EU) 2019/1156 and Regulation (EU) 2019/1156 into the national law of each Member State, including the latest requirements surrounding the appointment of a paying agent when marketing a UCITS fund. #DesignLaw purists may ponder about the rationale for the Community Designs Regulation recognising utility models (which, like #patents, protect technical #inventions) as a valid form of priority for registered designs (which concern a product’s appearance, not its functionality).
