Please read these terms and conditions carefully as they apply to your use of this website (the “Site”) and to any correspondence by email between you and us. The Site includes First Title Online Services (“FirstTitle Online”) By proceeding with access to the Site you are deemed to have accepted these terms and conditions. If you do not agree with these terms and conditions you must leave the Site immediately.
Terms of use

Our usage of your personal information is governed by our Privacy Policy. Please read this carefully as it deals with your rights and our obligations in relation to your personal data, including what we can do with it, to whom we may disclose it together with your rights of access.

The term “First Title Insurance plc”, “First Title” or “us” or “we” refers to the owner of the Site whose registered office is ECA Court, 24-26 South Park, Sevenoaks, Kent, TN13 1DU. Our company registration number is 01112603 and we are registered in England. The term “you” or “your” refers to the user or viewer of the Site.

Copyright in the whole and every part of the Site belongs to First Title or the First Title group, unless otherwise indicated, and may not be used, sold, licensed, copied or reproduced in whole or in part in any manner or form or in any media by any person without the prior written consent of First Title.

Accuracy and Validity of Information

Whilst we take all reasonable steps to ensure that the information contained on the Site is accurate and up-to-date, it is nonetheless supplied on an “as is” basis and accordingly we do not accept any liability for any errors or omissions.

If you are in any doubt as to the validity of information made available on the Site, we recommend you seek verification by contacting us.

Your use of any information or materials on the Site is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through the Site meet your specific requirements.

Variations

We reserve the right to update these terms and conditions from time to time without notice to you. We recommend you regularly revisit this page to ensure you have seen and are aware of our latest terms and conditions.

Jurisdiction and Choice of Law

The Site is established by First Title in England. Any use of it shall at all times be governed by English law and, in the event of any dispute, the relevant parties shall irrevocably submit to the exclusive jurisdiction of the English Courts.

To the extent that any part of these terms and conditions of use is found to be invalid, unlawful or unenforceable by any court of competent jurisdiction such part shall to that extent be severed from the remaining terms and conditions all of which shall remain in full force and effect as permitted by law.

Know Your Customer

Where the total premium charged exceeds £2,499.00, First Title will rely on your obligations under the Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (as per Regulation 39(3)), unless you advise us of any objection. We confirm that we are aware that ultimate responsibility for the verification of our customers still lies with ourselves.

Communications

You should also be aware that communications over the Internet, such as emails, are not secure unless they have been encrypted. Your communications may route through a number of countries before being delivered – this is the nature of the Internet. First Title cannot accept responsibility for any unauthorised access or loss of personal information that is beyond our control.

Use of the Site

The Site is intended for Commercial use only. Interference or entry to the Site with intent to corrupt, damage or deny service is taken seriously and we will take such action as is necessary to protect the Site from any such activities.

Trade Marks

All trademarks reproduced on the Site are registered trademarks within the First Title group. First Title or its group Companies may also claim rights in other trademarks, service marks, logos and icons contained on the Site. All rights are expressly reserved.

All trademarks reproduced on the Site, which are not the property of, or licensed to the operator, are acknowledged on the Site.

Terms and conditions of products

The content of the Site does not constitute an offer by us to sell products and services. Your request to purchase a product or service represents an offer by you that we may accept or reject and will be subject to the terms and conditions of that product or service.

The information and descriptions on the Site do not necessarily represent complete descriptions of all terms and conditions in relation to our products and services. Specific details will be included in the schedule of cover, policy documents and/or conditions of purchase issued to you.

You must ensure that the details you give to us while using the Site are correct and that all questions are answered fully to ensure you receive the level of coverage you require. You must also have sufficient funds to cover the cost of any product or service, which you intend to purchase. Failure to provide us with all the relevant and accurate information may jeopardise a claim.

First Title shall not be deemed to provide cover and shall not be liable to pay any claim or provide any benefit under any Policy to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose First Title to any sanctions, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United States of America.

Availability of the Site

Whilst we take all reasonable steps to ensure the Site is always accessible we will not be held liable if, for any reason, the Site is unavailable for any period. We may also have to suspend access to the Site for routine or emergency updates and maintenance but we will endeavour to keep any disruption to a minimum.

In addition we cannot warrant that the Site will be free of viruses or defects of any description and we will not be held responsible for any technical problems you may suffer as a result of your use of the Site.

Use of FirstTitle Online

You will be asked to register a username and password if you wish to purchase or obtain a quote for our product(s) through FirstTitle Online. It is your responsibility to keep your username and password confidential, by:

-ensuring your Login details are kept secret;

-not allowing others to use your Login details;

-changing your Login password at regular intervals; and

-contacting First Title immediately if you believe your Login is being used by another party.

First Title reserves the right to withdraw access to the Site without prior notice if we believe that there has been a breach or abuse of the system.

By logging into FirstTitle Online you confirm that you are authorised by the Financial Conduct Authority or an exempt professional firm under the Financial Services and Markets Act 2000.

Please note the Site is designed to be used by professional bodies only (i.e. lawyers, brokers, and licensed conveyancers) and is not intended for general public use.

Please also note that cover will be provided on the basis that you act as “agent” for the Insured in accordance with the Consumer Insurance (Disclosure and Representations) Act 2012 (“the Act”), effective from the 6 April 2013, and that the Insured has complied and will continue to comply with its duty as a “consumer” under the Act to take reasonable care not to make a misrepresentation to us.

By placing a policy on risk you confirm you are complying with your regulatory obligations. If you are charging a fee for arranging a policy please confirm the amount of the fee (plus any VAT or other taxes payable) by email to info@firsttitle.co.uk.

Complaints

We aim to provide you with a first class service. However, there may be times when you feel that we have not done so. If this was the case, we would rather be told about it so that we can do our best to solve the problem. If you have a complaint then please contact us at complaints@firsttitle.co.uk and we will make sure that your complaint is considered appropriately.

If there is a disagreement between us which we cannot resolve to your satisfaction, you can refer any relevant complaint to the Financial Ombudsman Service (FOS) who, once contacted, will liaise with us on your behalf. FOS will then inform you directly of its decision. Referral to FOS will not prejudice your right to take subsequent legal proceedings. Financial Services Compensation Scheme (FSCS)

Should First Title Insurance plc become unable at any time to meet claims against it, the Insured’s interests will be protected by the Financial Services Compensation Scheme.

There are maximum levels of compensation the Insured can receive under the Scheme. The Insured will normally be covered for at least 90% of the payment due under the Insured’s policy.

Third Party Websites

The Site may also contain hypertext links to websites operated by third parties. The responsibility for the operation and content of those websites shall rest solely with the organisation identified as controlling the third party website and will be governed by the third parties’ separate terms and conditions. Links are provided for convenience and inclusion of any link does not imply endorsement in any way of the site to which it links. We accept no responsibility or liability for the contents of any linked website, site access or password usage.

You may not create a link to the Site from another website or document without First Title’s prior written consent.

Disclaimer

Whilst First Title uses all reasonable efforts to ensure that the information contained on the Site is current, accurate and complete at the date of publication, no representations or warranties are made (express or implied) as to the reliability, accuracy or completeness of such information. First Title, therefore, cannot be held liable for any loss arising directly or indirectly from the use of, or any action taken in reliance on, any information appearing on the Site. Content and information provided by third parties other than First Title is identified clearly where it appears. We publish this content as supplied to us and are not responsible for its accuracy or timeliness. You must take appropriate steps to verify this information before acting upon it. Liability

Nothing in these terms and conditions shall exclude or limit our liability for death, personal injury or fraud.
