Abstract
תקציר בעברית: המאמר עוסק במשמעות החוקתית של חוק-יסוד: ישראל – מדינת הלאום של העם היהודי ("חוק הלאום"), בהתחשב בכך שרבות מההוראות המופיעות בו מצהירות על מוסכמות המקובלות על רוב מכריע בקרב אזרחי ישראל, ולכן אינן עומדת לכאורה בפני איום רובני ממשי. המאמר בוחן הסברים אפשריים לחקיקה חוקתית כזו – מעמד הצהרתי, אפקט פרשני – ומתמקד בהסבר חלופי, לפיו עניינו של חוק הלאום הוא בהכנת תשתית חוקתית ל"יום סגריר", כלומר לעידן מדומיין בו יאבד הרוב היהודי בישראל, ועקרון הכרעת הרוב לא יספיק עוד כדי לשמר את הדומיננטיות היהודית במרחב ישראל דמוקרטי. משטר חוקתי שמשמר דומיננטיות לתרבות המיעוט מעורר כמובן קשיים מוסריים מובהקים, וגם שרידותו הפוליטית אינה גבוהה. ועדיין, ניתוק אנליטי בין האופי הדמוגרפי של המדינה וההצדקות לערכים החוקתיים שלה הוא בעל ערך לחשיבה הן על עתידים אפשריים למדינת ישראל, הן על ההווה שלה.
English Abstract: The Article concerns the constitutional significance of Basic Law: Israel – The Nation State of the Jewish People (‘Nationality Law’), considering that many of its provisions include norms that are accepted by a broad majority of Israelis, and hence do not face practical majoritarian threat. The Article explores several explanations to such constitutional legislation—declaratory effect, interpretive impact—and focuses on an alternative explanation: that the Nationality Law was enacted in anticipation of a ‘rainy day,’ an imagined future in which Israel no longer has a Jewish majority, such that majority rule alone would no longer be able to sustain Jewish dominance in a democratic Israeli sphere. A constitutional regime that preserves the dominance of a minority culture invokes obvious moral difficulties, and its political viability is also questionable. Still, there is value in distinguishing between the demographic character of the state and the justifications for its constitutional values—for considering both possible Israeli futures as well as its present.
