The Procurement Act 2023 received Royal Assent on 26 October 2023 and will “go live” on 28 October 2024.

Where can I find information on the consultation on the draft regulations to implement the Procurement Act 2023?

Part 1 of the consultation ran from 19 June to 28 July 2023. This part of the consultation focussed on areas of the Procurement Act 2023 which require lists, calculations or further definitions. The draft regulations consulted on are called ‘The Procurement Act 2023 (Miscellaneous Provisions) Regulations 2024’. Further information on Part 1 is available here

Part 2 of the consultation is running from 17 July to 25 August 2023.  This part of the consultation mainly focuses on the transparency provisions in the Procurement Act 2023. The draft regulations being consulted on are called the  ‘The Procurement (Transparency) Regulations 202X’. How does the Procurement Act 2023 affect Scotland?

As procurement is a devolved matter, the Scottish procurement rules are largely unaffected by the reform of the procurement rules that apply in the rest of the UK.    

The Procurement Act 2023 contains provisions intended to ensure that Scottish contracting authorities can access frameworks and dynamic markets established by contracting authorities in the rest of the UK.
